WebshopTerms & Conditions
General Terms and Conditions
These General Terms and Conditions of Sale apply to all purchases or the use of services via www.aerotechnik.ch, the online shop of AEROTECHNIK FAHRZEUGTEILE AG (hereinafter referred to as the website) as well as to direct purchases made by telephone, e-mail, or at trade fairs or at the company’s headquarters.
The special conditions applicable to the purchase of certain products are defined separately: the product offers published online are valid only as long as they are visible on the website and while stocks last. The images shown on the website are for illustration purposes only and are not binding. The information and explanations provided in catalogues, brochures and information sheets are for clarification only and are not binding.
Aerotechnik accepts no responsibility for any errors or inaccuracies in connection with the illustrations, diagrams, explanations, etc. mentioned in the referenced documents.
Prices
The prices shown on the website are stated exclusively in Swiss francs and include VAT, unless there is a clear indication that the price is subject to VAT. Shipping costs are not included and are charged separately. Payment for all orders is accepted exclusively in Swiss francs.
Aerotechnik reserves the right to change prices at any time. However, for products ordered by customers, the prices valid on the order date and stated on the order confirmation always apply.
Conclusion of Contract
Products and prices published in the online shop constitute an offer. However, this offer is always subject to the (sale-dissolving) condition of impossibility of delivery or an incorrect price indication (on the part of the manufacturer or Aerotechnik).
The contract is concluded as soon as the customer places an order with Aerotechnik. This can be done in person, by telephone, by e-mail or via the Aerotechnik online shop. Receipt of an order is communicated to the customer by means of an automatically generated order confirmation sent to the e-mail address provided. Receipt of the automatically generated order confirmation does not constitute a guarantee that the product is actually available or can be delivered. It merely informs the customer that the order placed has been received by Aerotechnik and that a contract has therefore been concluded, which is subject to the condition that delivery is possible.
Payment Terms
The price invoiced is the one stated on the order confirmation sent to the customer.
All products must be paid for in the manner specified when the customer account was created:
- Cash payment at the AEROTECHNIK headquarters.
- Bank transfer to one of the specified accounts before the goods are dispatched.
- Using the following credit cards: EuroCard/MasterCard, Visa, Postcard, PostFinance.
All payment transactions are processed in the secure zone according to the highest possible security standards ("https://"). The data stored by Aerotechnik serves as proof of all transactions that have taken place between Aerotechnik and its customers. The data stored by the payment system serves as proof of the financial transactions. The payment card will only be charged when the order is dispatched. In the case of partial deliveries, only the costs for the products shipped plus postage will be charged. Payment is due within ten days of receipt of the invoice to one of the specified accounts.
Shipping costs
The customer bears the costs for delivery of the goods. Exception: if free delivery has already been agreed before the order is placed.
The following costs are to be borne by the customer:
- Reminder fees in the event of non-payment within 30 days: CHF 5.- per reminder.
- Collection costs in accordance with the effort incurred by the Creditreform Association.
- Default interest: 10% per year, from the invoice due date until full payment of the outstanding amount.
Exchanges, Returns, Warranty Claims and Complaints
Complaints regarding defective goods and/or services, as well as returns, must be submitted by the customer exclusively and directly to AEROTECHNIK. The existence of such disputes does not release the customer from the obligation to pay the invoice or the total amount in dispute.
For returns of goods, provided the customer has already paid the original invoice in full, the refund will be made to the bank or postal account specified by the customer and held in the customer’s name.
It is the customer’s responsibility to inspect the goods immediately upon delivery and to report any defects or deviations from the order. The statutory provisions on notification of defects pursuant to Art. 201 of the Swiss Code of Obligations (OR) apply.
We only accept returns of items that are in their original packaging, unused, clean, fully returned, undamaged, and accompanied by the label and/or proof of purchase.
Used goods or items that have been mounted on vehicles cannot be returned. Important for rims: Before mounting the tires, the fit and clearance of the rims must be checked.
The noise levels of sport exhaust systems may vary. For this reason, compliance with the original values cannot be guaranteed.
In the event of a return, the customer is responsible for the shipping costs as well as the shipping risk. The goods can be returned by post or dropped off free of charge in Stein am Rhein.
The return must be sent to the following address:
AEROTECHNIK FAHRZEUGTEILE AG
Hofwisenstrasse 17
CH-8260 Stein am Rhein
Once the returned goods have been received, Aerotechnik will inspect the return and decide whether it is in perfect condition and whether a credit can be issued. The refund will be made to a postal or bank account held in the name of the respective customer.
Warranty
Warranty claims must be clarified with our sales team before any return shipment. The delivery note and the goods in their original packaging must be provided.
The invoice for the product serves as the warranty certificate. Replacement or repair under warranty does not extend the original warranty period.
Contract Termination Clause
If the customer fails to meet any of their obligations in whole or in part, or does not comply with a payment deadline, Aerotechnik reserves the right to demand immediate payment of all outstanding amounts of any kind, to suspend all deliveries, or to terminate the current contract.
Applicable Law | Disputes
This contract is governed by Swiss law. The place of jurisdiction is Stein am Rhein.
